Please read this privacy policy (“Policy”) which sets out the data processing practices carried out through the use of the Internet and any other electronic communications networks by PharmiWeb 2002 Limited trading as PharmiWeb Solutions, in particular through either the PharmiWeb.com website or other sites owned and managed by PharmiWeb Solutions, including but not limited to Detail-Direct.com, HospitalPharma.com and PharmiWebSolutions.com (together the “Site”).

1 COLLECTING PERSONAL INFORMATION

Our Policy conforms with your statutory rights under the Data Protection Act 1998. It is very important for us to safeguard your privacy while also providing a personalised and valuable service. We collect the following personal information from you throughout the Site:

the information you submit when you register to use the Site, store a Curriculum Vitae or resumé (“CV”) for the purpose of job applications or upload a CV to our CV database (“Database”);
the information you submit when you complete a voluntary questionnaire;
if you are an employer, information about the transactions you undertake including details of payment cards used; and
automatically retrieved information, such as information about your browsing patterns on the Site (please also see the section below relating to cookies).

We recommend that you don’t submit sensitive personal information to the Site, such as information about:

your racial or ethnic origin;
your political opinions;
your religious beliefs;
whether you are a member of a trade union;
you physical or mental health or condition;
your sexual life; or
any offences you have committed or are alleged to have committed.

If you do choose to submit sensitive personal information to the Site, you authorise us to retain and use it in accordance with this Policy.

2 USE OF PERSONAL INFORMATION

The personal information collected throughout the Site is used by us to satisfy the expectations and requirements of our users, for instance as part of a job application. We also use it to administer user registrations, respond to your queries about the Site and operate and improve the Site.

The automatically retrieved information is only used in aggregate form and no individual will be identified. The aggregate data allows us to analyse the site traffic and manage our relationship with advertisers and thus provide a more relevant service to our users (please also see the section below relating to cookies).

Email and postal addresses supplied to us allow us to send you important information about changes and improvements to the Site. Each time you receive a message or mail shot, you have the option to decline to receive further marketing information relating to our activities.

Through your use of the Site you may submit information to third parties, for example by applying to a job advertised on the Site or by allowing your CV to be searchable by companies looking for candidates to fill roles. We have no control over such third parties and we are not responsible for their use or retention of your personal information. We try to limit access to use of the job advertisement and Database services to paying employers, recruitment professionals, law enforcement and governmental bodies but we cannot guarantee this.

The Site may contain links to other sites which are outside our control and are not covered by this Policy. If you access other sites using the links provided, the operators of these sites may collect information from you which will be used by them in accordance with their privacy policy, which may differ from ours.

If you have uploaded a CV and have provided a referee, it is your responsibility to ensure that the referee has consented in writing to having his/her contact details forwarded to any prospective employer and being contacted as a result.

Given that the Internet is a global environment, using the Internet to collect and process personal data necessarily involves the transmission of data on an international basis. Therefore, by browsing this Site and communicating electronically with us, you acknowledge and agree to our processing of personal data in this way.

3 RETENTION OF PERSONAL INFORMATION

We will retain your personal information as long as you are registered to use the service.

If you use the Database service, your jobseeker status affects how the Database will treat your CV in a search. When you are an ‘active’ or ‘passive’ jobseeker your CV will be searchable. However, when you are not your CV will no longer appear in a search. An ‘active’ jobseeker is a person who is looking to transfer for jobs as soon as possible. A ‘passive’ jobseeker is someone not looking to move job but is open to offers.

If you have uploaded a CV you can update or ask us to remove your CV either from the online storage system or the Database at any time. We will retain an archive copy, which is only for our internal audit purposes and will not be passed to any third parties.

4 PHARMIWEB ALERTS

The job alert service aims to match your career requirements and preferences with appropriate vacancies as advertised on the Site. Our email alerts, advertising messages and newsletters aim to provide you with relevant news and information. As a user of any of these services, we may contact you by email from time to time to tell you about improvements to the site, or send you relevant messages from our sponsors or clients. We will only send you advertising messages or relevant messages from our sponsors or clients if you have signed up to the relevant alert service and you can unsubscribe at any time from any of your alerts [by sending us an email at the address below or by clicking on the link at the bottom of the alerts] . Advertising messages may contain promotional content relating to products and/or services from pharmaceutical and biotech companies.

5 COOKIES

A cookie is a small piece of information sent by a web server to a web browser, which enables the server to collect information from the browser. We use cookies to identify you when you visit the Site and to keep track of your browsing patterns and build up a demographic profile.

If you are a registered user of the Site our use of cookies also allows you to be presented with a personalised version of the Site and have access to information about your account.

Most browsers allow you to turn off cookies. If you want to know how to do this please look at the help menu on your browser. However, switching off cookies may restrict your use of Site.

6 GENERAL

We will only disclose personal information to other companies within our group of companies, government bodies and law enforcement agencies (where required to do so) successors in title to our business and suppliers we engage to process data on our behalf.

1 AVAILABILITY OF THE SITE

Although we aim to provide you with access to our Site at all times, we make no promise that our Site will meet your requirements or is fault free. We may also temporarily suspend the whole or any part of the Site to allow for repairs, maintenance or the introduction of new content or facilities.

You must bear the risks associated with your use of the Internet and any incompatibility of our Site with any of your software or equipment.

2 YOUR USE OF THE SITE

Your use of the Site is subject to you complying with any policies and/or disclaimers posted on the Site from time to time and accessible by you.

You may not use the Site for any of the following purposes:

transmitting any unlawful, threatening, objectionable, abusive, discriminatory, defamatory or indecent material or material which is deliberately intended to upset other users;
transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any applicable laws, regulations or code of practice;
gathering personal information about other users for uses such as marketing, sale or promotion of goods or services, market research or any other type of research;
spreading viruses or any other components with harmful or contaminating effects;
interfering with any other person's use or enjoyment of the Site;
making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner;
directly or indirectly impersonating any person; or
uploading and storing inaccurate biographical information about you.

You will be responsible for our losses and costs resulting from your breach of this section 2.

We also reserve the right to suspend your use of the Site immediately and without notifying you if we reasonably believe that you are using the Site in any manner that is inappropriate or otherwise in breach of these Terms.

Because we obtain the content provided on our Site from a number of sources including third parties, we cannot and do not warrant or guarantee that the information, content or software contained on, distributed through, or linked, downloaded or accessed from the Site (together the “Materials”) are accurate, complete, up to date or reliable. All information provided is of a general nature and is not intended to address a specific question or problem.

You should not rely on or use any content without using your own judgement, or if you are not a professional, without seeking appropriate professional advice. Any reliance you place upon any Materials will be at your sole risk and it is solely your responsibility to ensure that the Materials meet your requirements.

The views expressed by third parties placing Materials on the Site are not necessarily representative of our views.

As a convenience to you, the Site includes links to other Internet sites which are beyond our control. We are not responsible for content on any site outside the Site. We are also not responsible for any transaction concerning goods or services available either through Materials from third parties on the Site or links to other Internet sites from the Site. If you use such links, your use of other Internet sites is subject to the applicable terms and conditions of those sites.

We encourage you to exercise discretion while browsing the Internet from the Site. You may be directed to sites containing information that some people may find offensive or inappropriate.

5 ADVERTISING AND SPONSORSHIP

Part of the Site may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Site complies with relevant laws and codes. We will not be responsible for any error or inaccuracy in advertising and sponsorship material.

6 INTELLECTUAL PROPERTY

The content on our Site is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of the Site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on our Site without our written permission.

7 OUR LIABILITY

If we are informed of any inaccuracies in the Materials, we will attempt to correct the inaccuracies as soon as we reasonably can. Similarly if we are informed of a problem with access to or the availability of the Site, we will attempt to correct the problem as soon as we reasonably can.

However, because the Site is provided "as is" and "as available" free of charge to you, where we breach these Terms or are negligent in providing the Site, we will not be liable to you for any loss or damage (whether you suffer it as a direct result of using the Site or not). To the extent we are allowed to under applicable laws, we exclude all promises about how we provide the Site, including whether it is of satisfactory quality and or is fit for a particular purpose. Our liability is not limited in the case of death or personal injury caused by our negligence.

If you apply for a job on the Site or upload your Curriculum Vitae or resumé (“CV”) to the Site, we are not responsible for any third party’s use of that application/CV or any personal information contained in either of these.

If you are a consumer your statutory rights are not affected.

8 CAREERS SECTION

This section applies to you if you use the careers section of the Site (“Careers Section”) in a jobseeker capacity. The Careers Section is made available by us solely for the purpose of allowing you to search for and apply for potential jobs or for uploading your CV to our searchable database.

Finding jobs
If you become a registered user of the Site, we offer two ways of finding jobs:
1. Searching for and applying for jobs
  By accessing the Careers Section, you will be able to look up details of employers advertising jobs (“Advertisers”) and apply for jobs. You are responsible for making the application with the Advertiser. We will not make contact on your behalf. You will be able to upload a version of your CV that we will store on the Site. When you apply a job on the Site, to make the process simpler, you can choose to send this version of your CV to the Advertiser. This version of your CV will not be searchable by Advertisers or part of our CV database.
2. CV database (“Database”)
  The Database allows you to complete fields relating to your personal details, skills, qualifications and experience to create a pro forma online CV that is searchable by companies looking for candidates to fill roles (“Corporate Subscribers”).
  
  Corporate Subscribers will only be able to search for your CV if you have set your status (in the ‘Modify my account’ section of the Site) to ‘active’ or ‘passive’ jobseeker. You can choose which Corporate Subscribers are able to search your CV by adding them to what is called your ‘white list’ (also in the ‘Modify my account’ section of the Site). When new Corporate Subscribers are added to the Database service we will send you an automatic email notification and you will be given the option of adding them to your ‘white list’. Corporate Subscribers will use the same search fields used by you to complete the pro forma CV.
  
  Weekly activity emails provide you with feedback of activity on your CV in the last seven days. This feature has to be turned on for you to receive such emails.
Your responsibility in the Careers Section
We do not check the information provided by Advertisers or Corporate Subscribers in the Careers Section and you will need to satisfy yourself that the information provided is accurate. As we have no control over the accuracy of the information provided, and do not endorse or recommend Advertisers or Corporate Subscribers in any way, you acknowledge and agree that we are not liable for any information provided in the Careers Section.

We are not considered an employer as against you in relation to your use of the Site. We are not involved in the transaction between you and Advertisers or Corporate Subscribers. Therefore you agree that you assume all the risks involved in such a transaction. We are not responsible for any employment decisions by Advertisers or Corporate Subscribers.

9 CORPORATE USERS

If you are a corporate user you should also ensure you have read and understood any terms and conditions which are stated to be relevant to your use of the Site and any services provided through the Site at the time you register with us or during your use of the Site.

10 PERSONAL DATA

By using our Site you are agreeing to the collection and use of your personal data as set out in our Privacy Policy.

11 INTERNATIONAL USE

We make no promise that materials on the Site are appropriate or available for use in locations outside the United Kingdom, and accessing the Site from territories where its contents are illegal or unlawful is prohibited. If you choose to access this Site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

These Terms shall be governed by and interpreted in accordance with English law and the parties submit to the exclusive jurisdiction of the English courts in relation to any disputes arising out of or in connection with them.

12 GENERAL

You may not assign, sub-license or otherwise transfer any of your rights under these Terms.

If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. If you breach these Terms and we ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these Terms.

We shall not be responsible for any breach of these Terms caused by circumstances beyond our reasonable control.

It is not intended that a person who is not a party to these Terms shall have the right to enforce any term of these Terms under the Contract (Rights of Third Parties) Act 1999.
